Affidavits in Ontario — What You Should Know
What an affidavit actually is
An affidavit is a written statement of facts that you swear or affirm to be true in front of a commissioner for taking affidavits. In Ontario this is governed by the Commissioners for Taking Affidavits Act. The commissioner confirms your identity and witnesses you swearing the statement — the commissioner does not verify that the facts themselves are true.
Affidavit or statutory declaration?
They are prepared the same way, but they are used differently. An affidavit is typically used in court proceedings. A statutory declaration is used for other official purposes where a sworn statement is required but no court is involved. If the form you were given names one specifically, use that one.

Oath, affirmation, and exhibits
You may swear an oath or make an affirmation — an affirmation carries exactly the same legal weight and the same consequences, without a religious element. If your affidavit refers to attached documents, those exhibits are marked and initialled at the appointment, so bring them with you.
Knowingly swearing a false statement is a criminal offence. Read your affidavit carefully before you come.

Frequently Asked Questions
Do I have to swear on a religious book?
No. You can make an affirmation instead of an oath. An affirmation has exactly the same legal weight and the same legal consequences — it simply has no religious element. Tell us which you prefer at the appointment.
Can someone else swear the affidavit for me?
No. Only the person making the statement can swear or affirm it, and they must attend in person with valid photo identification. That is what the commissioner is confirming.
Does commissioning my affidavit mean the contents are proven true?
No. The commissioner confirms your identity and witnesses you swearing that the contents are true. The truth of the statement itself remains your responsibility — and knowingly swearing a false statement is a criminal offence.
How much does Affidavits cost?
Service fee: $70. Fees are determined by the number of notarization signatures, not the number of documents. We accept Cash and e-Transfer.
Do I need an appointment?
We are open 7 days a week: Mon – Fri: 10:00 am – 6:30 pm, Sat – Sun: 12:00 pm – 4:00 pm. Call 416-951-3301 before visiting so we can have everything ready — same-day and last-minute visits are usually no problem.
What should I bring?
A valid government-issued photo ID (Passport or Driver’s License) and your documents, unsigned — the notary must witness your signature. If you need certified copies, bring the original documents. Free printing and copying is available.
