Commissioning Oaths and Declarations

What a commissioner for taking affidavits does

A commissioner administers the oath or affirmation for affidavits and statutory declarations under Ontario’s Commissioners for Taking Affidavits Act. The commissioner confirms who you are, witnesses your signature, and records that the statement was sworn or affirmed before them.

Commissioner or notary — which do you need?

If your document is a sworn statement for use in Ontario, commissioning is normally what is required. A notary public can do that as well, and can also certify true copies and notarize documents intended for use outside Canada, where the notarial seal is more widely recognised. If the form or the institution names one specifically, follow what it says — and if you are unsure, call us before you come.

Oath or affirmation

You choose. An oath has a religious element; an affirmation does not. They carry identical legal weight and identical consequences for a false statement.

What is the difference between a commissioner of oaths and a notary public?

A commissioner for taking affidavits administers oaths and affirmations for sworn statements, which is generally what Ontario documents require. A notary public can do that and also certify true copies and notarize documents for use abroad. We are both, so you do not have to work it out before you arrive.

Is an affirmation as valid as an oath?

Yes. An affirmation carries exactly the same legal weight as an oath and the same consequences for a false statement. The only difference is that an affirmation has no religious element.

What should I bring?

A valid government-issued photo ID (Passport or Driver’s License) and your documents, unsigned — the notary must witness your signature. If you need certified copies, bring the original documents. Free printing and copying is available.
