Small Claims Court Documents in Ontario

What the court handles

Ontario’s Small Claims Court hears civil claims up to $35,000, not counting interest and costs. It is designed to be used without a lawyer, which is why the paperwork itself matters so much — most avoidable problems come from documents that are incomplete or improperly sworn.

Documents that need to be sworn

Affidavits filed in support of a motion, affidavits of service showing how and when the other side was served, and statutory declarations all have to be sworn or affirmed in front of a commissioner for taking affidavits. Exhibits attached to an affidavit are marked and initialled at the same appointment.

Where to find the official forms

Ontario publishes the Small Claims Court forms and step-by-step guidance on ontario.ca. Download the current version of the form you need and bring it unsigned — forms do get updated, and an out-of-date version can be refused at filing.

How much can you claim in Ontario Small Claims Court?

The limit is $35,000, excluding interest and costs. Claims above that amount are heard in the Superior Court of Justice instead.

Does my affidavit of service have to be sworn?

Yes. An affidavit of service is a sworn statement and must be signed in front of a commissioner for taking affidavits or a notary public. Bring it unsigned along with photo identification.

We are open 7 days a week: Mon – Fri: 10:00 am – 6:30 pm, Sat – Sun: 12:00 pm – 4:00 pm. Call 416-951-3301 before visiting so we can have everything ready — same-day and last-minute visits are usually no problem.

What should I bring?

A valid government-issued photo ID (Passport or Driver’s License) and your documents, unsigned — the notary must witness your signature. If you need certified copies, bring the original documents. Free printing and copying is available.
