Powers of Attorney in Ontario
The two Ontario documents
Ontario has two separate powers of attorney. A Continuing Power of Attorney for Property covers financial and property decisions and can continue to operate if you later become mentally incapable. A Power of Attorney for Personal Care covers healthcare, housing and other personal decisions. They are separate documents and you may want one or both.
Who can and cannot witness
A power of attorney must be signed in front of two witnesses, and Ontario law disqualifies several people from witnessing: the attorney you are appointing, that attorney’s spouse or partner, your own spouse or partner, your child, and anyone under 18. Using a disqualified witness is a common reason a document is rejected later, when it matters most.
What we do and what we do not do
We notarize and commission the document and make sure it is properly signed, witnessed and sealed. We do not advise you on which powers to grant or how the wording should read — for that, speak with a lawyer. If a bank or institution has given you their own form, bring it and we will work from it.

Frequently Asked Questions
Can my spouse or my child witness my power of attorney?
No. Ontario law does not allow your spouse or partner, your child, the attorney you are appointing, that attorney’s spouse or partner, or anyone under 18 to act as a witness. You need two witnesses who fall outside all of those categories.
Do I need one document or two?
It depends what you want covered. A Continuing Power of Attorney for Property deals with finances and property; a Power of Attorney for Personal Care deals with health and personal decisions. They are separate documents. Which you need is a legal question for a lawyer — we handle the notarization once you know.
Does the person I am appointing have to come with me?
The person granting the power must attend in person with valid identification. Requirements for the attorney and the witnesses depend on the document you are signing, so call us at 416-951-3301 before the appointment and we will tell you who needs to be there.
How much does Power Of Attorney cost?
Service fee: $70. Fees are determined by the number of notarization signatures, not the number of documents. We accept Cash and e-Transfer.

We are open 7 days a week: Mon – Fri: 10:00 am – 6:30 pm, Sat – Sun: 12:00 pm – 4:00 pm. Call 416-951-3301 before visiting so we can have everything ready — same-day and last-minute visits are usually no problem.
What should I bring?
A valid government-issued photo ID (Passport or Driver’s License) and your documents, unsigned — the notary must witness your signature. If you need certified copies, bring the original documents. Free printing and copying is available.
